General Terms and Conditions
Note: The following is a translation of the German General Terms and Conditions. In case of legal disputes, the original German version shall prevail.
I. Scope
These terms and conditions apply to all contracts between PETSPECTIVE – Sandy Löwe Photography (hereinafter: "Contractor") and the clients (hereinafter: "Client") for the execution of photo shoots and the use of the resulting images.
II. Conclusion of Contract & Booking
(1) Bookings are made online via the Contractor's website or as scheduled slots during action days/trade fairs. The process corresponds to the online booking process: automated contract including terms and conditions, privacy policy, liability waiver, digital signature, invoice, and advance payment.
(2) Spontaneous bookings at events/trade fairs can be made on site; payment is only due after a successfully completed shoot.
(3) Changes, cancellations, or rebookings must be communicated to the Contractor exclusively by e-mail.
III. Prices
The prices published on the website at the time of booking apply. Price changes are reserved, but do not affect already confirmed bookings.
IV. Payment
(1) Payments are made in advance by bank transfer or via common online payment methods of the payment provider (e.g., Google Pay, Apple Pay, PayPal, credit card).
(2) The invoice period is 10 days. Without timely payment, there is no right to execution or appointment reservation.
(3) For trade fair/spontaneous bookings, payment is made on site as soon as it is certain that the shoot can be carried out.
V. Cancellation, Refunds & Replacement Appointments
(1) Cancellations must be made in writing by e-mail.
(2) Refund policy:
up to 4 weeks before the shoot date: 100% refund
up to 14 days before the shoot date: 50% refund
from 14 days before the shoot date or no-show: no refund
(3) Goodwill cases:
If the dog passes away, a full refund will be issued upon proof.
In case of sudden illness or heat of the dog, a free replacement appointment will be offered, provided the Contractor is informed within 24 hours of becoming aware.
In case of long-known circumstances (e.g., illness existing for weeks or foreseeable heat), the right to a refund or replacement lapses.
VI. Execution & Cooperation
(1) The Client receives a training plan in advance to prepare the dog (does not apply to spontaneous bookings).
(2) The cooperation of the dog is crucial for success; there is no guarantee of success.
(3) The Contractor may abort the shoot if safety or animal welfare is compromised or if there is insufficient cooperation. A refund will only be issued as a gesture of goodwill.
(4) The Client is obliged to supervise their animal during the shoot.
VII. Selection, Editing & Delivery
(1) The Contractor will provide a selection gallery approximately one week after the shoot.
(2) The gallery remains accessible for at least 2 weeks; an extension or reactivation is possible for a 30 € processing fee.
(3) Ordered downloads and prints will be edited after selection.
(4) The editing time for the final motifs is usually 4–6 weeks; in case of high order volume, illness, or seasonal workload, the delivery time may be extended.
(5) Color deviations between monitor and print representation are technically determined and do not constitute a defect.
VIII. Usage Rights of the Client
(1) The Client receives a simple, non-transferable usage right for private use (e.g., social media, private prints, albums).
(2) Commercial use, reproduction, or transfer to third parties is prohibited without a separate agreement.
(3) Upon request, a commercial license can be agreed upon for a separate fee.
(4) The Client obliges to name the photographer when publishing on the internet – as far as technically possible (e.g., "Photo: PETSPECTIVE / Sandy Löwe").
IX. Rights of the Contractor (Self-use)
The Contractor may use the recordings created during the shoot for own purposes (website, social media, exhibitions, publications, advertising). By agreeing to these terms and conditions, the Client consents to this.
X. Liability & Insurance
(1) Participation in the shoot is at your own risk.
(2) The Client is liable for all damages caused by their animal and ensures that a valid pet owner's liability insurance exists.
(3) The Contractor is unrestrictedly liable for intent, gross negligence, and for damages to life, body, or health. In case of simple negligence, liability is limited to the breach of essential contractual obligations and to the typical, foreseeable damage.
(4) No liability is assumed for technical problems outside the Contractor's sphere of influence (e.g., power outages, internet disruptions, server problems).
XI. Downloads & Prints via Pictrs
The ordering, payment, delivery, and right of withdrawal for downloads and prints are handled by Pictrs GmbH as an external provider. Their terms and conditions and withdrawal regulations apply.
XII. Right of Withdrawal for Online Bookings
(1) For online bookings, consumers generally have a 14-day right of withdrawal (§§ 355 ff. BGB).
(2) This right of withdrawal lapses if
- the shoot is to take place within these 14 days and
- the Client expressly requests that the Contractor begins execution before the withdrawal period expires,
and confirms that they lose their right of withdrawal upon complete fulfillment of the contract (§ 356 Abs. 4 BGB).
(3) Services fully rendered on site are excluded from withdrawal according to § 312g Abs. 2 Nr. 9 BGB.
(4) For digital content provided via Pictrs, only the terms and conditions and withdrawal regulations of Pictrs GmbH apply.
XIII. Archiving
The image data is archived by the Contractor for several years. There is no right to permanent storage.
XIV. Force Majeure
In the event of force majeure (e.g., illness, accident, official measures, pandemics, technical failures), the Contractor may postpone or cancel appointments. Claims for damages are excluded. Already paid amounts will be refunded or credited towards a replacement appointment.
XV. Set-off & Retention
The Client may only set off with undisputed or legally established claims or assert a right of retention.
XVI. Final Provisions & Jurisdiction
(1) German law applies.
(2) For consumers, the statutory jurisdiction regulations apply.
(3) For merchants, legal entities under public law, or special funds under public law, the place of jurisdiction is the Contractor's registered office.
(4) Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr. The Contractor is not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
